Motor Vehicle Register (MVR) Privacy Statement – Wayne Kirk Motor Group Limited
Who we are
Wayne Kirk Motor Group Limited is a registered motor vehicle trader. In the course of buying, selling, and managing vehicles, we sometimes need to confirm registered person details via the Motor Vehicle Register (MVR) maintained by Waka Kotahi NZ Transport Agency. Where required, we access MVR information under an authorisation made pursuant to section 241 of the Land Transport Act 1998 and the conditions set by Waka Kotahi.

What we access
For current vehicles only, we may access the name and address of the current registered person, and vehicle information, subject to the terms of the authorisation and any conditions imposed by Waka Kotahi (including security and permitted purpose controls). Individuals who have opted out or have confidential status are excluded from s241 authorised access.
Why we access your information (permitted purposes)
As a motor vehicle trader, our permitted purposes include:
- Verifying ownership — to confirm the vendor is the registered person of a vehicle we are proposing to purchase;
- Completing transactions correctly — to help verify a change of registered person for transactions where we are the purchaser or seller; and
- Safety recalls (wholesalers only) — to contact the registered person where a vehicle is subject to a listed safety recall to advise on required actions for safe operation. [https://gazette.govt.nz/notice/id/2022-au4073]
Our legal basis and conditions
- The authorisation framework sits under s241 of the Land Transport Act 1998, which allows the Secretary/Registrar (after consulting the Privacy Commissioner, Chief Ombudsman and Commissioner of Police) to grant access for specified purposes and subject to conditions, for periods up to five years.
- Waka Kotahi publishes Gazette notices setting out standard terms/purposes for classes such as Registered Motor Vehicle Traders (current notice runs 1 Nov 2022 – 31 Oct 2027).
Your right to opt out
If you’re an individual and do not want your name and address to be automatically released to authorised users under s241, you can opt out via Waka Kotahi here:
transact.nzta.govt.nz/transactions/PersonalInfoAccess/entry. Opt out does not stop all release—it means your details won’t be disclosed under automated authorised access, and requests may instead be handled by Waka Kotahi on a case by case basis under other provisions.

We access MVR information only for the permitted purposes described above and we keep it secure as required under the authorisation conditions and applicable New Zealand privacy law.
